At CopingWell Solutions Inc. (hereinafter “CopingWell”, “we”, “us” or “our”), protecting and respecting the privacy and personal information of our JoyPop™ application (the “App”) users is important to us. Please take the time to read this Privacy Policy carefully. If you are not the age of majority in your jurisdiction, please have a parent or guardian review this Privacy Policy with you.

By using the JoyPop™ App, you consent to our collection, use, and disclosure of your personal information in accordance with this Privacy Policy. This Privacy Policy should be read in conjunction with the App’s terms and conditions (the “Terms”).

Privacy laws generally define “personal information” as any information about an identifiable individual, which includes information that can be used on its own or with other information to identify, contact, or locate an individual. This Privacy Policy describes how we process your personal information when you use the App. We will only use your personal information in accordance with this Privacy Policy or as otherwise permitted or required by applicable law. We take steps to ensure that the personal information we collect about you is adequate, relevant, not excessive, and used for limited purposes.

Subject to legal and contractual requirements, you may refuse or withdraw your consent to our collection, use, storage, transfer, disclosure, or communication (collectively, “processing”) of your personal information at any time by contacting our Privacy Officer, whose contact information is set out below. If you refuse or withdraw your consent, we may not be able to provide or continue to provide you with products, services, or information that may be of value to you.

We reserve the right in our sole discretion to revise and update this Privacy Policy from time to time. Any and all such modifications are effective immediately upon being published and apply to all access to and continued use of the App. You agree to periodically review this Privacy Policy in order to be aware of any such modifications and your continued use shall be your acceptance of any such modifications. We will notify you in advance of any material changes to this Privacy Policy and obtain your consent to any new ways that we process your personal information, in each case to the extent required by law. Your continued use of the App after we make changes indicates that you accept and consent to those changes, so please check this Privacy Policy periodically for updates. Moreover, if you provide CopingWell or our service providers and agents with personal information of another individual, you represent that you have all necessary authority or have obtained all necessary consents from such person to enable us to collect, use, and disclose such personal information for the purposes set forth in this Privacy Policy. If you do not have the necessary authority or consents, please do not provide the personal information of that other individual.

The App may include links to third-party websites, plug-ins, services, social networks, or applications. Clicking on those links or enabling those connections may allow the third party to collect or share data about you. If you follow a link to a third-party website or engage a third-party plugin, please note that we do not control these third-party websites, these third parties have their own privacy policies, and we are not responsible or liable for these policies. We encourage you to read the privacy policy of every website you visit.

Is my personal information collected?

We make efforts to limit the amount of personal information we collect about you. When accessing the App, you may be provided with a user identification (“ID”) code that you will enter during the onboarding process to help limit the amount of personally identifiable information you need to provide. You may not be required to enter any other personal information when you begin using the App.

While we try to limit the amount of personal information we collect about you, we may collect and use the following information in connection with your use of or access to the App, some of which may be or include personal information:

  • Information related to details about your device, including operating systems, device types, and system performance;

  • Information related to App usage patterns (e.g., frequency of use, duration of use, sequence of feature use); and

  • Information that you provide in the App.

As much as practicable, all of the information listed above will only be associated with your user ID code. We do not collect data related to “cookies” (this refers to information that helps a website or other platform remember information about your last visit). Unless otherwise indicated in this Privacy Policy, the Terms, or in the App at the time you provide the applicable information, we do not analyze, share, or use the actual content of personal information you provide in the App, but we may anonymize your personal information so that it is no longer associated with you and we reserve the right to use such anonymous data for any purpose.

How is my information used?

The purpose of collecting the information above is to:

  • Monitor and address any issues affecting user experiences with the App;

  • Ensure the App is displayed and functioning effectively and efficiently for various devices;

  • Understand App usage patterns and level of engagement with the App and various features;

  • Inform ongoing planning related to feature modification and development; and

  • For any other purpose you have consented to or that is permitted by law.

We may transfer personal information that we collect or that you provide as described in this Privacy Policy to contractors, service providers, our subsidiaries and affiliates, and other third parties we use to support the App (such as developers that assist us with improving and optimizing the App), who are contractually obligated to keep personal information confidential, use it only for the purposes for which we disclose it to them, and to process the personal information with the same standards set out in this Privacy Policy.

Without limiting the foregoing, the App may be used within research studies led by academic researchers or community/organization partners, which you may be provided the opportunity, but are not obligated, to participate in. If you are participating in a research study, you acknowledge that a research team (that may be independent of CopingWell) may access certain information about you or your use of the App to answer specific research questions. All research studies will have their own policies, which will further detail the information to be processed, and which should be reviewed prior to participating in a study. Only the information set out in the applicable research study policy will be shared with research teams, following your consent to participate in the research study. Your decision on whether to participate in a research study will not otherwise impact your use of the App.

How is my information stored?

The security of your personal information is very important to us. We use reasonable physical, electronic, and administrative measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure. Your information is stored on a secure, password-protected Cloud server located in Canada, access to which requires 2-factor authentication. Data is encrypted during transmission (“encrypted” means the data is scrambled in a way that it cannot be accessed without a digital key). Data is stored on industry-recognized infrastructure that is encrypted and meets or exceeds the standards for secure data handling. Data is retained for as long as needed to address the purposes mentioned above. Once data is no longer needed, it will be destroyed securely. While we use industry-recognized methods for securing your information, web-based transmission of data may not be completely secure. We cannot guarantee the security of your information. If you are concerned about anything regarding your data, you should contact our Privacy Officer. If we become aware of any security concerns or breaches, information will be posted on our website and notifications may be sent out via the App itself.

Accessing and Correcting Your Personal Information

It is important that the personal information we hold about you is accurate and current. Please keep us informed if your personal information changes. By law, you have the right to request access to and to correct the personal information that we hold about you.

We may request specific information from you to help us confirm your identity and your right to access, and to provide you with the personal information that we hold about you or make your requested changes. Applicable law may allow or require us to refuse to provide you with access to some or all of the personal information that we hold about you, or we may have destroyed, erased, or made your personal information anonymous in accordance with our record retention obligations and practices. If we cannot provide you with access to your personal information, we will inform you of the reasons why, subject to any legal or regulatory restrictions.

Our Privacy Officer is responsible for coordinating the investigation of any complaints and resolving privacy-related issues, and will manage any complaints received in a timely manner and provide you with a response to your complaint.

You have the right to make a complaint at any time to the relevant privacy regulator. We would, however, appreciate the opportunity to address your concerns before you do so. In Canada, you can contact the Office of the Privacy Commissioner of Canada or the relevant provincial privacy commissioner for your province of residence.
